ERICSON FINE ART PHOTOGRAPHY: Provides photographic services (Service/s) to clients (Customer/s) who agree to the below Terms and Conditions (Terms)

WRITTEN INSTRUCTIONS : We require written instructions detailing the service/s (photography and or digital image files) required by you the Customer to ensure we provide you with what you are contracting Ericson Fine Art Photography to supply. Emailed instructions are adequate for this purpose with such written instructions superseding any verbal instructions received either prior to or after receipt of the written instructions. Should a Customer need to alter their instructions at any time, new written instructions must be supplied before the commencement of the service.

Should a change of written instructions be received by Ericson Fine Art Photography from the Customer, Ericson Fine Art Photography reserves the right to change the quotation, location and or date of the service at the sole discretion of Ericson and notify the Customer prior to commencement or continuation of the service and or product.

While all care is taken to ensure that the items we are photographing for you are handled with care, we accept no responsibility should any item be damaged by accident or any other means and the Customer indemnifies Ericson Fine Art Photography from any claims for damages loss of product and or loss of income related to the loss or damage of any property of the Customer by any means what so ever.

Should there be a fault or a failure to comply with the written instructions of the Customer in the supply of any service/s (photography and or digital files) provided by Ericson Fine Art Photography liability is limited to either re-providing the service/s and or digital files or a refund of the fees paid to Ericson Fine Art Photography for the supply of the service/s and or digital files at the discretion of the Customer.

The re-provision of the service/s and or digital files or refund is subject to the return of any images and or digital files created by Ericson Fine Art Photography and subsequently delivered to the Customer. The Customer must provide a written acknowledgement that such images have not been duplicated and or retained and or used by and will not be used by the Customer at any time.

Transportation of any goods or items to and or from Ericson Fine Art Photography’s premises and or nominated location are the responsibility of the Customer.

Should a Customer fail for any reason to collect the Customers property from the premises of Ericson Fine Art Photography or any other reasonable nominated place as advised by Ericson Fine Art Photography within 21 days after being advised by a representative of Ericson Fine Art Photography that the said items are available for collection such items may be disposed off by Ericson Fine Art Photography at the sole discretion of Ericson Fine Art Photography.

COPYRIGHT : As a commercial photography studio and in accordance with Australian Copyright Laws governing commercial photography the copyright of all images created by Ericson Fine Art Photography resides solely with Ericson Fine Art Photography.

USE OF COPYRIGHT IMAGES : The use of images created by Ericson Fine Art Photography for any purpose other than the purpose nominated by the Customer in the written instructions provided to Ericson Fine Art Photography is forbidden. Should a Customer want to use the copyrighted images owned by Ericson Fine Art Photography for any purpose other that those nominated in the written instructions the Customer must obtain written permission from Ericson Fine Art Photography prior to such use. Ericson Fine Art Photography reserves the right to decline permission for the use of the copyrighted images/files and reserves the right to charge a fee for such use should permission be granted.

ATTRIBUTION : All the service/s (photographic images and or digital image files) created by Ericson Fine Art Photography must be attributed to Ericson Fine Art Photography as per Australian Copyright and/or Attribution laws and cannot be attributed to any other person or organisation.

RELINQUISHMENT OF TITLE : (Disposition of uncollected items) Should a Customer fail without reasonable excuse to collect the Customers property from the premises of Ericson Fine Art Photography or any other reasonable nominated place as advised by Ericson Fine Art Photography within 21 days after being advised by a representative of Ericson Fine Art Photography that the said items are available for collection the Customer relinquishes title/ownership of such items to Ericson Fine Art Photography who may dispose of those items at the sole discretion of Ericson Fine Art Photography.
